Definitely get some decent legal advice, although I don’t think that the Police will use your previous offences it’s better to be safe than sorry.

Other than that sent a copy of a book heralding the Napoleonic wars to this stupid bint (wrapped in a St George’s cross flag) just to remind her who’s side she’s on. (That was for you Asher!)

We will all sign a “Sussex is great, leave him alone" petition so really there is nothing to worry about.

what pisses me off about all this is the so called witness.
How can he/she say how fast you were going??
they weren't sat in your car with you and was looking at the speedo.

Unless you was going exsesive speeds (100 +) then obviously you could tell but if you was going between 55 - 65 then no one could tell the difference. This witness is a cunt.
Plain and simple to me. French cock pulled out on you so it's his fault.

Also tell the plice to fuck off cos they can't do shit about your previous. They were a long time ago and have nothing to do with what happend.

Hang on a minute ! Don't mean to put a dampner on things, but....

1. If Sussex was over the limit he is at fault (although I'm not saying he was)
2. If he was breaking the speed limit he is at fault (although I'm not saying he was)
3. If he was driving recklessly then he is at fault (although I'm not saying he was)

Noone here apart from Sussex knows the truth.

One and three are irrelevent, if anyone was driving recklessly it was the bloke who pulled out in front of him.

As for number two, even if he was speeding it's not his fault somebody pulled out in front of him.

How can the witness prove you were speeding? Who's right is it to say that you were reckless driving?

No-one. They can't charge you because a witness has said you were dangerously driving. I would certainly get some legal advice. Past motoring offences (10 Years ago) should have no effect.

Keep yer head up fella, don't let it get to you (hard I know). All us guys and gals on here can do is give you advice.

The points above aren't irrelevent.
If you pulled out of side road onto a main road that had a 40mph speed limit and you saw a car approaching you, I think it would be reasonable to assume he might be doing around 40mph and that you would have enough time to make the manouevre.
If someone just happened to be doing 80mph then obviously what happened to Sussex is going to be more likely.

However, having said all that ,sue the French bastard !!!

The French bloke would have to be completely blind if he didn't notice Sussex was possibly speeding, judging speed is one of the first things you learn when you go out on the road.

Just like to say in the past this happened to me. There were no witness's tho. basically I was overtaking and the car i was passing decided to pull over. He caused a lot of side damage to my car. His insurance company tried to blame me saying I was speeding. I explained that if I was speeding or not, I was overtaking and your client pulled over without obviously looking in his mirrors. They couldn't prove anything and knew they were in the wrong. They paid out in the end after a long struggle.

Where dores it teach you in the Highway code how to judge the speed of an approaching car.
You have to make a judgement yourself based on the speed limit of the road, conditions etc.
You would be a lot more careful crossing a dual-carriageway with a 70mph speed limit than you would a road that had a 30mph limit.

I was doing about 80 in a 60 limit, but it's long straight stretch of road, so he'd have seen me coming a quite a way off. I saw him start to pull out but thought he'd see me and stop. Erm, he didn't.

Drove the new wagon past there yesterday and the skid marks are gone (due to the heavy rain and it being a busy road I guess)

It's slightly uphill and this woman was coming the other way. She stopped when it happened to check we were ok etc. and gave us both her address for insurance purposes. I thought nothing more of it.

When I left, they were having a chat by his car, so that's probably where all this bollocks has come from  :roll:

good luck m8.dont want to sound a cunt but im sure the

police will jump at the chance to bring up previous.

so get a solicitor asap without a doubt,one thing i allways

say when anyone goes to court is allways be prepared for

custodial and dont listen to people who allways say it will

be ok..otherwise its hard to take.

dont wanna sound like im trying to scare you but you gotta look at every angle...good luck though and chin up.

It's not taught in the highway code, but one of the first things my instructor drummed into me was to judge how quickly traffic was coming towards you when you were sat at a junction, because if you were to pull out and cause a car to slow down at all, you would fail your test.

One of the reasons you need to be 17 to drive is so that your judgement has developed.  If you drive by the highway code then you are incredibly naive - very few people stick rigidly to a speed limit, and people do speed excessively.  Like it or not.  If you pull out in front of someone you are in the wrong in my book.  

But having said that I always thought insurance companies blamed the person who went into the back of the other car, even if something like this has happened?  This is why it fucks me off so much when people do this to me, particularly when they then proceed to sit in the outside lane and drive line astern with the car to the left of them, who inevitably is hogging the middle lane leaving the inside lane free.   :x
