About a week an half ago, the wife ordered a new car, put the deposit down, and signed a contract. They have rung her today to say her colour is no longer available.
Surely the garage in question has breached the contract?

Surely the garage in question has breached the contract?
I'd imagine it would give you grounds to cancel the purchase and get your deposit back. But nothing more than that. Or use it as a bargaining tool to get a few quid discount on another colour.

Dealers do this all the time and it's never their fault. It's always down to the manufacturers descretion. As mentioned they will have this covered. It happens fairly often with orders for new cars. Sadly you have no choice but to either cancel (if the colour bothers you that much) and pay the cancellation fee or choose another colour.

Silver is quite easy to keep clean though! Every red car I have owned (1) has faded.

Can they get away with a cancellation fee? I could understand them being covered so you couldn't sue them for failing to provide the car ordered, but forcing you to take another colour or pay a cancellation fee seems a bit crazy. Only time I bought a new car I wanted it immediately and the dealer found one ready to go that was close to what I wanted at another dealer, then they sorted out some kind of swap deal to get it. Took less than a week in total.

I think it depends how far advanced the order is in all fairness. If it's not actually been factory ordered you'll probably escape a fee. But if it's being made and shipped it's going to cost the dealership so they would want to re-coup that money back. I guess in this instance that probably won't be the case. My bad on that one.
