Really, it's not up to the family to decide whether she has mental capacity. The courts will decide that (or rather, a 'certificate provider'). If she does not have capacity then you (or another family member) need to apply to the Court of Protection to act as her Deputy.

Yeah much of this is down to bloody family not helped by the fact that house, mother and awkward family member (who has been merrily dealing with her affairs for ages and clearing said house) is c.350 miles from me!

Can I apply to the Court to act on her behalf if the document she needs to sign is for my benefit or will that make it awkward?

It will potentially be difficult. The Court expect the Deputy to act in best interests and for the Deputy to not personally profit from any decision. From the sounds of it, your situation could be very grey and you'd be wise to take some legal advice from a suitably experienced solicitor.

It was the last day of term today I've worked there 3 years and never had a sick day till today! We do get paid for holidays as our wages are spread across the year! Working in a primary school gives you a mega immune system!!

Pro rata JFW, which means although you get money your pay is for term time only. Without a sick note, your employer will assume you've been off work for 2 weeks, more than the statutory 7 days, so may not pay you.
