I think it only becomes a problem when there is sale in the offing. Hopefully, after the very public shenanigans of that court appearance, it can be sorted out amicably between all the parties.

I sincerely hope that is just what is happening at the moment.
Now it’s out in the open I expect so. Bit embarrassing for all parties concerned. last thing you’d want to happen to something you’re keen, very keen to keep a lid on is for it to become public. I expect there is a degree of duck paddling against a strong river, looks all quiet and stable on the surface but those webbed feet are going like fuck underneath. |

But the parties will have known that the proceedings (to include the recent applications for interim relief) would not be private and would be in the public domain. Also, modern dispute resolution practice essentially dictates that you try and sort out disputes before issuing proceedings.

I suppose if you have spent 12 months+ trying to get one party to deliver their commitments serious action is required, especially if said person was ploughing on. |
