As someone who grew up in South Africa, I can relate to the defence theory of saying a burglar was breaking in. Unfortunately, the reality is, in the Gauteng Province (Johannesburg and Pretoriaare both within this), there is a HUGE crime rate. In fact, Jo'burg was at one stage the murder capital of the world.
fortunately, not all of the country is as trigger happy, with the Western Cape being somewhat safer (of course, there are areas that are still dangerous), but on the whole, if you lived in Gauteng, every bump in the night would have you reaching for your gun, that conveniently lies next to your bed, as you would be living in a state of apprehension thinking someone would break into your property.

As a bloke who doesn't really want to kill anyone during my life, I find it weird to think there are people out there that would shoot first and ask questions later, unless your life was 100% in danger. By that I mean if someone was in my house without permission and I had a gun or a baseball bat or a knife to hand, I don't think I'd just go for the kill and then worry about the repercussions later. Perhaps shoot, hit, or stab to hinder their chances of damaging me or the family, but not go for the kill.
Obviously I'll never know unless I was in that situation, but to shoot someone four times, without being 100% sure of knowing I didn't know them or thinking if I don't shoot them they might kill me, seems a little OTT and worthy of the fuzz pressing charges.

Hope to fuck I never find myself in a situation like that, but you have to make the presumption that anyone who has gone to the trouble and expense of buying a gun, and then keeps it by thier bed while sleeping, probably does not think twice about unloading 3 or 4 slugs into an intruder. Being totally honest, I think I'd shit myself if I woke up to find an intruder in my house. Then I'd shoot the cunt as many times as I thought neccessary to make sure he was dead. Would anyone honestly think about shooting someone an 'appropriate amount of times' in order to avoid a murder charge?

Why would you need to make sure they were dead? Make sure they were unable to pose a threat to you but to kill them seems a far too excessive a force. If I had a basball bat I'd go for the knees, arms, back, but would automatically go for the head, especially if it was my wife!

I'd like to think I'd be composed enough to avoid one area, the head. Don't get me wrong if I felt my life was in danger I'd more likely be in survival mode and just do whatever. It's all hypothetical as like I say I haven't got a clue what would happen in reality. In truth I'm not trying to judge OP here.

I agree. My completely unqualified opinion is that this 'thought she was an intruder' stuff is complete and utter horse shit and will be proven so in Court. Does anyone really believe that?
