Cant change the defendant in a claim half way through the process.
That's statute
If I was Fitton I would have drawn indemnity clause into the heads of agreement to protect his investment. Only then could it be relisted under a separate claim number. Its complicated, its not a personal debt.
It is a commericial/venture debt which means a lot more tangled the web
I am sure that Fitton has played the correct hand, hence the "minor issues" to be agreed

If that is the case there would be another directions hearing and there would have to be another claim lodged with a different claim number.
I am really unsure of this, I am normally quite cute and up on this.....
As far as I understand, the only time a Director or (defacto) Director can be held personally liable for any company debts is compliant on two things
1. The said company is liquidated
2. The liquidation of said company is down to the "wrongful trading" of said individual(s)
Fuck I can see this getting messy mate

What I wan't to know is:
Will BP get his money back.
Of course I don't want Fitton and Co. to have to pay it, after all why should they. But did BP not give STFC over 1 Mil with all good intentions.
I hope he get's it back.
