my bank, rbs, charged me 38 quid for going 2 pounds over my overdraft limit with a cheque - is this legit? it does say in their t and c's that it would happen, seems a bit harsh though.

Nowadays you can get your charges refunded.  Call and complain.  I got a charge of 25 quid for going over and I wrote to them and I got a refund and another 25 quid on top compensation.

Depends who you bank with ... after all the compensation crap in the last six or months, some banks have put in new clauses regarding going overdrawn.
Lloyds for instance will charge you £30 if you go 1p over your agreed overdraft or if you go overdrawn without overdraft facility, but instead of this happening at midnight they will give you to 3.30pm on the day to put your account right.
So I would say it is totally legal and the banks are fighting back.

the OFT (office of fair trading) are taking them to court.

And your friend is still allowed to take her bank to court. it wont be heard until after the court case has finished but they are still allowed to do so.

the first results came out the other week and OFT have found the charges to be unfair.
now we have to wait to see what the final result is and if banks have to pay it all back.

Depends what you use a bank for, but do you honestly think they will help you in the future if youve asked for charges back.  Its stupid IMO
