In a 'David v Goliath' battle for justice Swindon Town Football Club has successfully overturned a decision of FIFA in a row over a 345,000 Euro compensation payment to French club AS Cannes.

Last year FIFA ordered Swindon Town to pay 345,000 Euro  to Cannes for the player Sebastien Ruster.Ruster had joined the League One club on a short term contract after having been released by Cannes.Cannes argued that it should receive compensation for the training it gave Ruster as it only released him due to the rules of the French Football Federation following the club's loss of professional status. As Ruster was unemployed at the time, Swindon Town did not consider Cannes was entitled to any compensation. Unfortunately for Swindon, the FIFA Dispute Resolution Chamber upheld Cannes' claim leaving the English club just one option - an appeal to the Court of Arbitration for Sport in Lausanne which has now overturned the FIFA decision and reduced the compensation payment to 20,000 Euro.



Chief Executive of Swindon Town, Sandy Gray, commented: "We are delighted with this decision. At no time did we believe that Cannes was entitled to compensation. The FIFA ruling last year was very disappointing, not only because we felt it was completely unjust, but also because we did not have the financial resources to pay such a substantial sum."

Swindon Town was advised by one of the country's leading sports law firms, James Chapman & Co of Manchester. Senior Solicitor Matthew Bennett who presented the case to the Court of Arbitration added:

"It is very unusual for the Court of Arbitration to overturn a FIFA ruling however this decision should encourage others to go the extra mile if they believe they have a good case. If a FIFA ruling goes against you it is always worth undertaking a careful review of the decision.Clubs should not be afraid to go to the Court of Arbitration as it is the Court's duty to look at all cases afresh and in this instance we are delighted that justice has been achieved."
