I'm having a bit of a dispute with my neighbour over our car parking. Doh We have been parking a car in a parking space at the end of our close because the lay-by we usually park in was full. Yesterday we had a note asking us not to park there! Yesterday the lay-by was full again when we got home so parked the car at the end of the close again. This morning there was another note saying it was residents only parking (no sign saying this) plus all the houses down there have their own drives. And that she had seen how many cars we had and would be contacting the Council?! We have 3 cars and 4 people living in our house. They have 2 cars and 2 people living in their house? This seems to me they have a car per person whereas we don't even have that! I just wanted to confirm that a sign had to be placed by the place we are parking if it was residents only and has anyone ever heard of this, you can only have a certain number of cars per house rule!

knock on the door and discuss itwith them.ask for proof etc then go from there

Is it private land ie someone's drive?

If not then yes there will need to have a sign for residents parking. Your neighbour obviously doesn't recognise the car.

Failing that Stab her.

Nope it's not private land, basically there was a show home office thing down there so they had extra parking spaces put in the road bit rather than just a big flat bit of tarmac. And she parks there because it's nearer her house. I think i'll go speak to her later and ask if she's got proof of the space belonging to her etc failing that i'll stab her!

It might not look like private land, but it could be. I have two spaces at my house, one directly in front of it but the other is across the way a bit. Legally I own the land, but I can't stop other people parking there (for legal reasons that I've momentarily forgotten). She could have a similar situation.

If it is your land (ie allocated parking space) no matter what distance from your house its your right to park there. Allocated spaces aren't always marked but are on the deeds of the property. I think it must be her land otherwise she wouldn't put a note on your car.

I had the same thing happen to me when I parked at my mum and dads earlier in the year. New people had moved in further down the street and starting putting notes on anyone who parked anywhere near their house.
The law states that if it is a public highway, with no parking restrictions on it, then you are free to park there. Simply because someone owns the property that you are parking in front of, it doesnt give them any further rights with regards to the space on the road.

As others have said, unless its private property, which is highly unlikely if its just a cul-de-sac, or marked residents parking, then there is nothing they can do.

As for my M&D's neighbours, I laughed in his face then proceeded to park there every day for 4 months!! He had to park on the pavement over the road and got several tickets for illegal parking!!! If only he'd been a bit more polite....

I park anywhere if i am able to with no parking restrictions.

At the end of the day i pay my road tax and will park wherever i can legally.

She hasn't clearly stated in etheir of her notes that it's her space legally, just that we don't have the right to park there because we don't live down in the cul-de-sac (i'm on the corner of the god damn cul-de-sac!) there are no signs and no other residents have objected I have asked my neighbours who also park there sometimes and they have said they also believe it's a public highway and anyone can park there because there are no signs. She hasn't even had the balls to put a house number or name on the notes so we know who she is, we just have a good idea who it is.

Ask her politely for a face to face chat.  She can then explain to you why she believes she has the right to ask you not to park there.

This sounds like a black & white issue; either you have the right to park there, or you don't.  If she provides you with reasonable evidence that the space belongs to her, you need to stop parking there.  If she does not, you carry on parking there and ask her, as nicely as possible, to mind her own business.

I don't mind not parking there if i'm not allowed, but it's the fact since we got the car in July we've parked in the lay-by all but twice and both times we haven't she's put a note on the windscreen, it's obvious we don't want to park there but in the situation we had to! Like you say Ardiles if I get proof i'll stop parking there, if I don't I will just say when we have to we will park there but she could use her drive, or use one of the other 3 spaces that never get used!

You could phone highways dept at the council. Ask if its a recognised highway, if it is and there are no parking restrictions you can park where you want ! Even if it is a private road it would have to be either owned or historically serve as original access specifically to her property to allow any restrictions. And of course if that is the case........stab her !
