There's this knobhead delivery driver across the road from work who keeps blocking the entrance/exit from the car park when making his deliveries.

He tells us that when he's delivering he's started his tacho break and therefore can't move his lorry even just 6 inches else he'll be breaking the law.

Is he being a complete dick?

If he has his tacho switched to break whilst working(loading-unloading)he'a breaking the law. He also should park legally to take his break anyway. Obstructing an exit is not a safe place to park and take a break.

He has probably ran out of driving time and has to  take a break but it has to be in a safe place. If he goes over his driving time he can explain why manually at the end of his shift. Unless he has good reason ie an accident hold up etc it will be down to poor planning on his part or the boss's

Ask for his boss'a number and phone them.

I have a feeling that drivers can't use delivery time as a rest period as they are still working. So the 45 mins break should start after the delivery.

I may be completely wrong, of course

Truck drivers have to take a bewildering amount of breaks.  45 minutes every 9 hours of driving, 9 hours break after arriving at a venue, a 24 hours break once a week and a 48 hours break once every fortnight.  Proves a pain in the arse to me as I have to arrange with venues for drivers to stay extra days at the venue to take their breaks.  Tachos are all digital now and we often have to get another driver in to move the truck round the corner.

Hes not really being difficult but should have more consideration as to where he parks to start with.

He does it every week. And yes, he was unloading when supposedly on a break, so next time he tells me he can't move the lorry because he'll be breaking the law I'll tell him he's already breaking the law anyway.

The law is an arse(eu legislation) and is confusing. A driver must t take a 45 min break after 4.5 hours of driving unless they have good reason to have to of continued. They can split it into a 15min and then a 30 min break but the 45 must be completed by 4.5hours. I've had to pull in Membury for 45 mins when nearly home etc as i would be breaking the law if i continued,even though i'm nearly back to base.

The driver concerned cannot simply park where he wants as i've explained above. He's breaking the law by working through his break too.
