Anyone know if I pay the full invoice prior to a court date, are you liable for the £50.00 costs?

in 2003 I paid my council tax up front and in full

February 2004 they try to take me to the magistrates court for non payment.

I went to court and held up the receipt.

Got costs awarded against me because I should have sent the receipt in negating a court appearance.

Moved into new office jan 2st 07.  Wrote to them giving details on 3rd jan 07.  Expalined as a business with a turnover of X I am entitled to a rates reduction of 25%.  They sent em a bill for the whole lot, I phoned them explaining if they send me the forms or the right bills I will pay in full.  Today a summons comes.

On the back it gived Q and A's so I ring up as it says to in the letter and the bloke says pay in full today and coasts or we go to court.  I said your company hasnt sent me teh informatiuon I needed and he said as a business I should have chased them, not vice versa.

Ive paid it in full now with the £50.00 but written a letter of complaint.

Think that might have been worth going to court over if you have the evidence to back it up. Letter of complaint sadly will probably fall on deaf ears as they have their money.

However, if you do eventually get the 25% reduction then you have a clear case of a screw up on their part, and you should demand (through court if needs be) the rebate on the amount you have already paid as well as the £50 costs ... plus a figure for your time and additional costs.

I realised that it wasn't the £50 - you would have an "STFC-like" business if that was ever going to break you !!  Wink

But they are treating you like a lump of dirt and deserve to be given grief in return.

SBC are useless FACT!!! I have a ninety pound bill here to pay as i did not put enough money in the car park machine i was 10p light. The multi story car park had a car broke down in the entrance and i had an appointment at the council office and was cutting it tight so went into princess street open air car park sent  letter with the fine notification and no reply sent again this time recorded and still no reply.. Now i have been served court papers and may have the bailiffs turning up. The sign has been renewed and i am out of pocket. as the court papers have to be signed by a solicitor,doctor or court representative and they all charge... so going to let it go to court. Dont get me started on council tax soapy tit wank

yes mate you are once proceddings have been issued you are libile for the full mount claimed by the claimant in this case the council. You will aslo be lible for any intrest they have claimed.

ps also make sure they file a notice of discountiune with court and ask for written proof that they have done so ie a copy of the letter to the court.
