Title: Michael Le Vell ....
Post by: fittons_coaching_badge on Tuesday, September 10, 2013, 14:41:21
Found innocent.

Adds weight to the argument the accused in these cases should not be named until sentence passed. The accuser was not in court so I suspect she saw it coming.

Exactly.

Surely the way to stop this, is to simply mirror the prison sentence he would have received and give that to the spurious accuser. Won't happen mind.

His word against hers. Down to who the jury believes. Jeremy Kyle would get the truth

Problem is, a lot of rape cases come down to the same as Arriba says- one persons word against another any very limited circumstantial evidence, with no other witnesses.

You can't prove that the accuser is making a false accusation and it's likely that many of them aren't, but you can't prove beyond reasonable doubt that the rape occurred either.

The rape conviction rate is very low compared to other crimes (http://www.theguardian.com/society/2013/apr/23/rape-conviction-rate-high - 63% is an all time high), and I suspect (although can't prove for obvious reasons) that 37% of rape cases are not false accusations.

Can understand that, but in the age of the internet I don't think it would make any difference...the name would be leaked one way or another.

Take this for example

http://www.dailymail.co.uk/news/article-2334483/No-10-rocked-secret-love-affair-Stunned-PM-holds-crisis-talks-fears-tryst-blow-political-agenda-water.html

Despite very strict contempt of court rules it's very easy to find out the parties involved...
