Ok, so, I'm off work sick at the moment. I have been since tuesday, and I've asked for my shifts to be covered until the end of the week (as although I'm recovering from said illness, I've now picked up a cold too). Now, my employer has told me he will need a sick note because when I return to work it'll have been over seven days since I last worked. But I'm not sure where I stand as I work shifts.

I've had tuesday, wednesday, thursday off and am due to have friday and sunday off also. After that I'm not due back at work until wednesday. Am I technically ill until I return to work?

I'll go find the number for HR later and ask them, but it's boring being ill, so I wanted to make a thread about it. Mostly so herthab can give me lots of sympathy.

If you notify them that you are fit to return to work before the 7 days have passed then you don't legally need to provide a doctors note.  HOWEVER, sick pay (above the statuary rate of £79.15) is normally at the managers discretion and if they want you to obtain a sick note before they will approve payment then you will need to do so - the problem you have is that you may have difficulty getting a doctor to provide a sick note after the illness has passed - particularly if you didn't see them whilst you were skiving ill.

Right, that sounds fine. I did see the doctor on monday afternoon so I think if necessary I could get a sick note. It's more a matter of principle now though as I feel my boss is trying to call my bluff.

So you were sick before Tuesday? Your 7 days starts from the day you were first ill, not from the day were first missed work -  When you complete your return to work form it will normally ask you the date of the start of your illness.

Are you taking Friday and Sunday as holiday or as part of your sickness?  If it is the latter and you were still ill AND provided a Doctors note covering those days most companies will re-imburse your holiday AND pay you

I was sick before tuesday. Technically I became sick 2 weeks before I took any time off (apparently I have post viral fatigue, so I go through periods of dizziness, get headaches and am generally lethargic).

My understanding is that for absences of 3-5 days from work (or 3-7 calendar days,) a doctor's certificate is not needed, but a self-certificate is required. Any absence longer than this requires a doctor's certificate (which have changed recently to 'statement of fitness to work')

However, payment or not depends entirely on employer's T&C and what is contained in your contract of employment. There are also qualification rules for Statutory Sick Pay (SSP).

If you haven't got a doctor's statement, you weren't technically 'sick' two weeks ago

I worked shifts years ago. Got lashed up pretty badly one night on a works do and passed out at work the next day as a result. I decided to make out I was actually ill rather than hung over and ended up going to the doctor to cover my tracks. Explained to the doctor that I passed out and that I worked shifts, he said it was fatigue and I needed bed rest so he signed me off from work for the next week. Result.

Good job you weren't successful at that interview. If fannying around behind the counter at Blockbuster is too taxing for you, a proper job would probably kill you.
