What do you reckon the chances of being successful are?

They've just broken the 10th start date they've given to start repairing our house after the July floods. They tried to shut my dad up by offering him £100 but he found that an insult and told them he'd see them in court....

They've now given a January the 7th start date which is 6 months since the floods happened now and its getting fucking ridiculous...

i'd go to the governing body or OFT / CAB, ask for advice or previous cases.

Already doing that but the fact their trying to fob people off with insulting offers has made my dad determined to sue them...

if you can find some other flood victims with the same insurance company it may strengthen your case in one of two ways:

a) they have already been sorted so you can claim you are being unfairly treated

b) they haven't been sorted and you can group together and mount a case.

I don't think suing is the way forward, why not try and get one of those national newspaper "troubleshooters to sort it out for you.

THe companies terms and conditions probably have all sorts of small print to cover them, but a national newspaper taking the story on will lead to bad publicity if they don;t sort it out.

I'm sure the Daily Express has a column like that btw.

ps I know I come across as a prick on here but when insurance claims are involed ie my job I am actully very clever.

I've worked previously in the insurance industry and have had success suing them, albeit about whether something was covered or not. To my mind, your situation is a straight forward breach of contract. Offering you money weakens any case they have. If the building company your insurers have provided are not reliable then ask for them for others. If they cannot line anyone up then suggest you appoint your own. I think you have been reasonable beyond what should be expected.
Personally, I would go back to them and tell them what you intend to do unless they have strong objections otherwise.

legal proceddings do not provide the swift sword of justice that people expect the defendant for example can have up to 6 weeks to respond to any proceddings from the date of service! Plus drawing a county court summons and getting it right is not all that easy. your summuary I bleive is a bit simplistic and your statment that the offer of money weakens their case is rubbish payment of a claim does not constitue an admission of libilty etc etc I got go on all but alas I actully have insurance claims to deal with !

As my Mum works for the council we've got the local MP involved (who made big threats to their CE apparently) as well as threatening legal action and suddenly they've guarenteed to have the house finished within 10 weeks starting January the 7th and will pay the contractors to work weekends if necessary.......funny that hey.
Their also looking at compensation now as suddenly they admit 6 months is a long time to wait.

Who says threats don't get you anywhere.  :soapy tit wank:

Well they've done it again, didn't turn up today......didn't ring to say they wouldn't be here or anything. So rang up to ask and their saying next week now...

Have you had an advocate draw up a letter yet Glos.  

Quite often just that first letter from an advocate will put the shits up a company and get them moving sharpish.

We had the local MP who is also a Lawyer write to them 2 months ago and doesn't seem to have done anything their cunts to be honest

Don't have house insurance and contents insurance done with C.I.S or Cunningham & Lindsey as they are basically a bunch of lying con artists
