What have you heard??

My dad knows something but refuses to tell me. Didn't say whether it was bad or good... I think he used the word hopeful. How can a WUP be hopeful?

14 days hence from the serving Dazz

basically what this guy has just done breaks the law

there should be no advertisement of a wup being filed with the debtor for 14 days from the date of service

If this is true, then this guy has just bought himself a whole world of shit

They went to give STFC the money last thursday. STFC turned it down on the basis that they would be breaking the law if they took the money and were later found to be trading as insolvent at that moment.

There's a possibility this could be true .....from the Government site...

No earlier than 7 working days after the petition is served on the company, but at least
7 working days before the hearing, the petitioner must advertise notice of the petition
(Form 4.6) in the London Gazette. This enables other interested parties to inform the
petitioner that they wish to attend the hearing, and whether they wish to support or
oppose the petition.

So that would mean it would have to be posted in the Gazette not earlier than Friday

BBJ 'oh, I getcha.like that is it? How about we slip ya 8 mill for that xmas do and you forego the rights to profits of future xmas work do's'

MD 'I'm ever so sorry, but we couldn't possibly take your money under false pretences'

BBJ 'like that is it? I see. ok we'll bung in a free season ticket for you & your cronies as you're all such MASSIVE football fans'

MD 'just give us a quid and everybodys happy'  :o

On the positive side, wouldn't a wup potentially kick some backsides to get the club sold. And what happened to all that jazz about a judge not going to wind up a company while there was still a viable take-over option.

Sounds like a wind up to me. If we are being wound up then why on earth would Andy Fitton still be holding talks????

I saw that post on thisis and thought "Well back it up then innit", and he couldn't.

I shan't be losing any sleep over that tosser tonight, and it is WAY past my bedtime time so goodnight all.

Yep....I wouldn't get wound up about a wind up about our winding up if I were you.

I wouldn't be surprised that HMRC has issued a WUP on Friday, as we all thought as Fitton had pulled out of a deal the previous day, and that it was just a matter of time before they did so.

'I think that anyone can get this info straight from the court as soon as a petition is filed.' - bullshit. so anyone can just turn up and ask the judge?

Feel free not to believe me. I am surprised that the Swindon Advertiser have not contacted HMRCs press office though. - they would have done. ive checked HMRC press office and there is nothing there.

Which creditors have given the club more time? NOT H.M.R.C, that's for sure. They filed a Winding Up Petition against the club at the High Court last Friday.

Check that with the Court! - what bloody court? how did he check? did he ring up and ask?!

THIS IS A WIND UP PEOPLE!

FWIW There's a few ways to stop a WUP but my eyes started glazing over, so I'll leave it to you chaps that know business law.  Too fucking cold down here to think

Title: Im sorry .............
Post by: wheretherealredsare on Tuesday, December 11, 2007, 22:09:23
Also FWIW nothing in the London Gazette at the moment:

http://www.london-gazette.co.uk/SearchResults.aspx?pg=1&sb=date&GeoType=London&st=adv&FDay=7&FMth=12&FYr=2007&TDay=11&TMth=12&TYr=2007&all=winding%20up%20petition&exact=Swindon%20Town%20Football%20Club&

Although from what was posted by Ironside and redbullzeye on P.2 if the petition was served on the club on the 7th it would not appear before the 14th. If AF completes by Thursday 13th and all debts are settled prior to publication could this negate any WUP?

No doubt others with more knowledge can advise on that.

Somehow I feel that AF would not be wasting any more time on this if there was any danger of it going tits up.

Looks like Wednesday could be busy.

HMRC Press Office only deal with enquiries from accredited journalists. If it is not supposed to be advertised for at least 7 days after serving I'm sure they will not tell anybody if a petition was commenced last Friday. In any case, they would probably refer enquiries to the Gazette.

I don't think it matters either way.  If Fitton is half the businessman he appears he will have factored this in and used it as even more leverage to force a decision. quickly   Fitton said that they had a deal in October/November? but that last minute additions caused the breakdown in talks.  I can't believe he would have gone back to the table unless it was on the basis of the original deal.  So I'm going to stay optimistic and hope for a celebration this Saturday

I'd be worried by that if I were him - Fred's track record on hunting that particular kind of quarry of late is impressive.

Look, guys, the reality is this - irrespective of any rumours, actual timings etc if the Fitton deal does not complete within the next week, we're dead in the water. And if it doesn't complete this week, I'd be extremely concerned that it won't complete at all. When the final nail gets hammered in the coffin is immaterial, unless you're especially fixed on going to Yeovil on Boxing Day for some reason

As regards to the posting of notices in the London Gazette....

I can speak from the horses mouth so to speak as I have been bankrupt before and my details are on there from 1998.

I filed for bankruptcy 11th June 1998 and the notice was not printed until 19th June 1998 so it took them 8 days to get it into print from filing for bankruptcy, so if that is a guide then there will not be a publication until Friday or Saturday.

As for the post on THISIS....I tend to ignore the vast majority on there as its total shit.....but I also know that if you pay your debts before the winding up notice is issued then the company can continue trading so if they have issued a winding up order against us and Mr Fitton takes over before next week then he can pay all the debts off in full and the company can continue trading.

I am sure that is how the procedure is, or it certainly was 9 years ago if it hasnt changed since then.

Until it's in the Gazette, presuming it's true, then we won't know anything.
