She has taken the original photo so it would quite strange if that was a crime, however, in electronic terms if you accept the picture and save it to your phone that counts as creating a new photo and that would be against the law. In practice i doubt you'd get done if it was for personal use but i don't think you could realistically make any money out of it with out attracting the attention of the boys in blue.
