STATEMENT

During a few days last week of email communication with Mr. Watkins of Clarke Willmott I attempted to ensure a complete public silence regarding any ongoing negotiations.

This informal agreement was broken within hours when Mr. Diamandis gave a 45 minute radio interview followed by an extensive newspaper article. It is unusual in the extreme for a recognised law firm to associate themselves with a public statement as inaccurate and misleading as the one posted on the Official Club website, and Consortium lawyers are seeking clarification of their motives and ethics in doing so.

There never was any formal agreement reached to maintain confidentiality and the actions of Mr. Diamandis demonstrate the futility of such an agreement even if it had been reached.

It is not the intention of the Consortium to enter into any vitriolic or fractious public comment as we see this as potentially damaging to the club and the team.

We do however reserve the right to respond to provocative and defamatory personal attacks by way of a dignified correction when absolutely necessary.

The consortium will continue to pursue its bid and recognition of the absolute necessity of due diligence in a company which has failed to submit unqualified accounts for many years. We appeal to all fans for patience and calm during this period of provocation and fervently desire that all enjoy a peaceful and Happy Christmas and New Year period blessed with 12 points.

I emailed Clarke Willmott to show my disappointment at what I saw as totally unprofessional conduct by associating themselves with such a provocative statement (and therfore not acting in the best interests of their client).

 I quickly received a very aggressive reply accusing me of libel - I had been very careful to avoid this and know it is totally unfounded. Apparently they have forwarded the email to the club's directors (despite the fact it was a personal email intended only for the recipient) and was told they will consult the board before deciding what action to take!

If you can post your email here for all to see if thye are treating you like that, I'm sure the club will publish it in a day or so and post a PR about it.  :wink:

Post it Migz. I doubt your sentiments are any different to the rest of a lot of us.....

I told Trevor Watkins that he was making his firm look unprofessional. His response:

"You will appreciate that your comments are potentially libellous. My clients will consider this and respond accordingly."

I am not going to put my email here because it pissed him off enough when done privately but it certainly was not libellous.,

  Without wishing to set you up as a martyr to the cause, I'm sure all Town fans would like to hear if Watkins' clients consider your comments libellous.

can it actually be libel if it's a personal message? i was under the impression libel and slander only applied to comments made in the public domain otherwise it's not defamation of character.

Erm, surely if you had a go at him for being unprofessional, you can't have been libelling his clients anyway? Wouldn't worry migz, it's probably the lawyers' equivalent of "Out of Office Auto Reply" - whereas the rest of us have "Hi, out for Xmas, back early Jan, any problems in the meantime please contact Nozza in Goods Inward", they have "You will appreciate that your comments are potentially libellous. My clients will consider this and respond accordingly."

I know damn well it wasn't libel - lawyers can't stand it when you have a pop at them (I should know -I become one of the evil bastards in September).

I mentioned a little bit about Diamandis - I pointed out that he has committed criminal offences and that perhaps he could get better legal advice because at the moment he seems to think that he's done nothing wrong. That pissed him off a bit.

I've always wanted to be a martyr to the cause. I was going to go to Iraq and blow myself up but this now seems a bit easier. Plus,  it is for a cause much more important than any of this Allah bollocks.

Ive heard that blowing yourself up hurts a bit.

The consortium still want to seek 'due diligence' - the process of researching and valuing the business (STFC). The consortium have had great difficulty in obtaining this information and so cannot put a price on the club i.e. nobody knows what the hell the club's financial position is and if there are any skeletons in the closet so to speak.

The bid has been rubbished publicly and the lawyer is associated with this. Furthermore, there is a statement on the official site. This could be deemed as unprofessional by some people, especially if an informal agreement was made not to release information publicly.

Basically the bid seems to be in a catch-22 situation. Diamandis claims that Power has the financial information and it hasn't changed 'much' since then. It may or may not have...but without obtaining this info it is difficult to table a 'serious' bid and satisfy the club's demands.

Well, we know it's worsened by £750,000, at least! :shock:
