WTF?!?!

That's not possible, surely?

The mortgage company(ies) would want to have a charge over the property and they'd never accept a mortgage if somebody else already holds a charge.

The thing is Sam, they've only just got married so they could get two mortgages in two names?

This really is fucked up. Even though a contract is signed he can pull out and get away with it scot free.  :x And we'd have lost the survey, fees, storage costs etc

The sale price of £169,000 would be insufficient to repay the two mortgages secured against (address).

nah nah nah

He will only have one mortgage

The other will be a loan secured on the property

That loan is in the form of a domestic debenture and a charge is taken out with land registry

Happens a lot

I had one with my car loan

No great ricky shakes

See if you can get your brief to put some pressure on the sellers lender, it's their call really if he can sell whilst in negative equity. You could argue it'd be better for them to at least recoup most of their debt and then pursue the outstanding amount afterwards.

I'm gonna give them a week, then I have to give them two weeks notice to terminate the contract. It really is a big joke. All my solicitor keeps sayin is that it can still fall through. Every fuckin 5 mins thats all he says. Someone hasn't done there job properly somwhere along the line....
