There's this knobhead delivery driver across the road from work who keeps blocking the entrance/exit from the car park when making his deliveries.

He tells us that when he's delivering he's started his tacho break and therefore can't move his lorry even just 6 inches else he'll be breaking the law.

Is he being a complete dick?

Yes and no Sam is your answer.

I sometimes take breaks when unloading my lorry....by law you are not meant to but many do...once you have put your Digital Tacho on break if the lorry moves(even one inch)then you have lost all the time off your break....so if you have had 35 mins....then have to move the lorry you have to start the break again.
But where he is being a knob is parking and blocking your work area....tell him in no uncertain terms he cannot have his break there and if he continues then its up to you how far you want to take it.
I often take breaks on the premises of people i deliver to...but never without asking for the manager and checking all is well with them....even if i get a whiff of them not being happy i will move the lorry and have my break elsewhere.


arriba is right....you are meant to have a break while not working(loading/unloading).....but if it takes an hour to do your unloading/loading then another 45 mins stuck on break then you can see why many drivers put there tacho on break while unloading.
It is almost imposible to cheat the new system with the Digital Card.....the computer warns you when a break is needed and there is no excuse not to have it.
For the record i rarely have a break while unloading/loading......you are usually parked in an area that requires you to move the lorry...which means losing the time you have had on your break.

The best way of dealing with this problem is to tell him before you unload him that he cannot take a break...if he kicks off....refuse to unload the lorry.

I may have it wrong, but I think this Lorry driver has nothing to do with Samdy other than he is blocking the way.

I think Samdy is in no position to refuse to unload this lorry.

My drivers reckon you can move a bit, just not significantly.  They will often have to manoveur around to get onto a loading dock and this is done whilst the are on the mandatory 9 hours.

You can do it,but only in exceptional circumstances.....but have to write it down on the digi print out explaining your reasons....but that can still get you into big trouble if the authorities believe you are abusing this loophole.

Yeah.  Seems to be a standard thing in Rock n Roll.  Movement is bugger all really though.  Ive had to arrange for them to stay at Bournemouth for 2 days so they can have their 48 hours before they go off to europe.  Luckily the venue can accomodate.

Sam, when you bring up the whole working-on-his-break thing, if he gets shitty just mention that you'll be getting in contact with VOSA, the professional drivers at RM (and most of our managers!) are wary of them.
