Title: New car Post by: Sippo on Monday, September 13, 2010, 15:57:57 About a week an half ago, the wife ordered a new car, put the deposit down, and signed a contract. They have rung her today to say her colour is no longer available.
Surely the garage in question has breached the contract? Title: Re: New car Post by: suttonred on Monday, September 13, 2010, 16:15:21 Dont be silly, read the small print, they'll have it covered.

I'd imagine it would give you grounds to cancel the purchase and get your deposit back. But nothing more than that. Or use it as a bargaining tool to get a few quid discount on another colour. Title: Re: New car Post by: 4D on Monday, September 13, 2010, 17:01:02 What colour did she/you want? What's available?
Title: Re: New car Post by: Sippo on Monday, September 13, 2010, 17:05:12 She wanted and signed for a red one but they only have silver now!
Title: Re: New car Post by: tans on Monday, September 13, 2010, 17:08:33 What car is it?
Title: Re: New car Post by: Iffy's Onion Bhaji on Monday, September 13, 2010, 17:08:47 Dealers do this all the time and it's never their fault. It's always down to the manufacturers descretion. As mentioned they will have this covered. It happens fairly often with orders for new cars. Sadly you have no choice but to either cancel (if the colour bothers you that much) and pay the cancellation fee or choose another colour.

Silver is quite easy to keep clean though! Every red car I have owned (1) has faded. Title: Re: New car Post by: reeves4england on Monday, September 13, 2010, 21:02:26 Silver > Red
Title: Re: New car Post by: Coca Fola on Monday, September 13, 2010, 21:10:08 Buy it in silver and paint it red yourself. :suicide:
Title: Re: New car Post by: 4D on Monday, September 13, 2010, 21:10:27 I've just got a new motor, third silver one in a row (Not my choice, it's just happened that way)
Title: Re: New car Post by: jonny72 on Monday, September 13, 2010, 21:38:15 Sadly you have no choice but to either cancel (if the colour bothers you that much) and pay the cancellation fee or choose another colour. Can they get away with a cancellation fee? I could understand them being covered so you couldn't sue them for failing to provide the car ordered, but forcing you to take another colour or pay a cancellation fee seems a bit crazy. Only time I bought a new car I wanted it immediately and the dealer found one ready to go that was close to what I wanted at another dealer, then they sorted out some kind of swap deal to get it. Took less than a week in total. Title: Re: New car Post by: Iffy's Onion Bhaji on Monday, September 13, 2010, 21:41:23 Can they get away with a cancellation fee? But if it's being made and shipped it's going to cost the dealership so they would want to re-coup that money back. I guess in this instance that probably won't be the case. My bad on that one. Title: Re: New car Post by: Arriba on Tuesday, September 14, 2010, 07:26:37 if the mrs will accept the silver one,try and bargain with the garage.say you will consider the silver one if a discount is applied.if they refuse say you will have to think about it,then contact the c.a.b.
if she flately doesn't want a silver one, then ask for your money back and take it from there. Title: Re: New car Post by: Sippo on Tuesday, September 14, 2010, 07:44:23 In the end she went in fuming. She got a better spec, a red car and full tank of petrol on delivery.
She's a bit happier now. Never use those cowboys at Motorpark. Title: Re: New car Post by: Arriba on Tuesday, September 14, 2010, 07:47:33 well if they gave her all that surely that is goood service?
Title: Re: New car Post by: Sippo on Tuesday, September 14, 2010, 08:09:32 Not really, because she's lost out on a free bluetooth, Ipod, tinted windows, sat nav. All worth £1300.

What is she gaining in its place? Just being nosey rather than argumentative. Title: Re: New car Post by: Barry Scott on Tuesday, September 14, 2010, 11:28:03 So they had a red one after all?

Indeed, I'd fucking flip. Someone fucks up and then you have to pay for their inability to provide what you paid for makes no sense. Title: Re: New car Post by: THE FLASH on Tuesday, September 14, 2010, 11:38:12 ALWAYS threaten with Which, What Car magazine......
Thats what my boss did when his Voyager kept on breaking down........What car wanted to do a piece on it.....surprise....it was replaced. Title: Re: New car Post by: Sippo on Tuesday, September 14, 2010, 11:42:21 Seat have a special offer of a seat ibiza for £199 pm with bluetooth, tinted windows, ipod, sat nav all free worth £1300. The deal is called good stuff.
She ordered the car, and then they ring up saying they don't have the 'good stuff' in red anymore and can only get it in silver. They offered her a red ibiza for the same price, the same car but without the freebies. So, in fairness you are paying the same and getting less. She hit the roof. Stormed in there, which is fairplay, and got a better model for the same price. It was the manner. They knew they couldn't get the car she wanted but decided to leave it for nearly two weeks! |
