The wife has possibly been caught speeding in Haydon Wick by one of those bike speed camera blokes. I'm sure I saw somewhere that they need to have a sign up within a certain distance??

I'm sure there's some legislation somewhere?

I believe the signs should be located at a point anywhere between the initial speed restriction sign and the camera; not necessarily within a certain distance of the camera; this then indicates that a speed camera is potentially operating within the area

Speed checks can be conducted even without the use of warning signs. Generally warning signs are used to stop you speeding and in areas where speed checks aren't frequent they will not erect warning signs. A warning sign is a guidline and not a requirement.

Aren't the bike blokes using radar guns as opposed to Cameras though? Because they don't need sign posting do they.

Also, if you're insured on the car write back saying it's an infringement of your human rights to state who was driving, so therefore they can't fine her, because it could have been you. Isn't that one of those little loopholes to exploit?

She was only doing 36 in a 30.

I think Deano is right.

Also seen a couple of unmarked cars in the last couple of days cruising around Haydon Wick, I guess they could e checking speed. I guess they have a new initiative to be seen out doing something now the fixed cameras have been turned off.

Did she get stopped and got given a ticket? If so, it was a radar gun which doesn't take a picture - it just records speed. If it was a camera they don't stop you, just send you a ticket in the post.

I got done for that too (in Aldermaston). Different force but I was offered a speed awareness course in lui of points. It was a bit more expensive to attend than the speeding fine. Your wife may get offered that choice to.

As a general rule of thumb, the action level is 10%+2. The warning signs are not connected to whether the ticket is valid or not;

no warning signs + speeding = ticket
warning signs + speeding = ticket

Your missus may be ok if it is her 1st offence as below 40 they may offer her a days "speeding awareness" course, the fine still stands but the points are not imposed.

£60 for the course but thats what the fine for speeding is anyway.

The bonus here is that you dont have to take 3 points and the tea and cakes are great :)

My mate got done going in to Wroughton, he went on the speed awareness course, cost him £60 (same as fine), didn't get the points - but the hotel it was held at charged him £3 for parking to take the course!!  Another friend got done on Wednesday on the Blunsdon to Highworth road, he was doing 41 in a 30.  No choice, £60 and 3 points!

1) Warning signs are only required with regard to fixed cameras, not mobile units.
 2) Speed awareness courses are a blessing, but are 'by invitation only' and only offered to a small percentage of drivers.
  3) Proof of the identity of the driver is no longer a requirement to secure a conviction. The onus is on the vehicle owner to declare who was driving, otherwise they take the rap. You have the right to ask for photographic evidence to identify the driver. This opens up possibilities. For instance, if there is no photo then you could take the rap, if say, your wife had 9 points and was trying to avoid being banned. But, if there WAS photographic evidence, then you can still get away with 'swapping identity' provided the driver was of the same gender. Obviously, it's no good taking the points (if you're a bloke) if the photo evidence clearly shows that the actual driver had wobbly bits. Confused ?
