Looks like my insurance company are defending my claim against them. Fucking cunts.

I was hoping to shit them up just by threatening court, how do I shit them up enough to settle up out of court?  I suppose I could see if I could getthe RSPCA involved or something?

I think glos got a local councillor onside, but it was obviously a different type of claim etc.

Why are they not allowing the claim if you don't mind me being nosey?

They are refusing to pay any of my vets bills even though my horse is insured for up to 5k for vets bills. My vets bill is now 5k.

Basically they told me my horse could not have his cancer removed without authorisation from them for a general anaesthtic. Their poor customer service meant I had to wait 2 months for this, which meant that my horses cancer got very large.  They are saying that I should have gone ahead with the treatment because it is my responsibility BUT it says in their small print I must get authorisation from them to proceed.  I was told by them my policy would be void if I went ahead without it.  Now my horse might have to be put down because of all this.  and they still won't pay the fucking £5k.

If anything I'd say you deserve the money +  compensation. I hate it when organisations seemingly play god by not doing their job properly.

write to them pronto, pointing out the differences to what they are saying to you, to what is there in black and white.
 tell them you will be instructing your lawyers to put a claim in against them unless they rectify the situation quickly.

every legal issue i have had when i know i have been in the right has been settled before i've even had to contact a lawyer.you may hve to persevere a bit but keep hassling them,and dont give up.
you will win in the end i'm sure of it.go back over the paper work to make sure you have it right,then let rip at them.

As Arriba says, but have it written by a solicitor on his official paper, if that doesn't move them, then it probably is court.

I think you will win as well.

Have you contacted the RSPCA, they will not let an animal suffer and does not mean putting the animal down either.
They will probably also help you with your claim giving significant weight  against the Insurance Company, they have a 24 hour hour helpline, sorry I dont have the number to hand.

You could always try writing to one of the financial sections of the press (eg Daily Telegraph,) who, as long as you have genuine grievances take great delight in getting settlement and extra recognition etc. You might want to exhaust normal channels though. Have in look in Saturday's money section for examples of the things they deal with.

Copy the relevant wording (include the whole sheet so they can see it is there policy) and highlight the relevant paragraphs for them.  Include this in a letter before action.

Amazing as it may seem, most of them have difficulty finding the wording of each policy so just rely on standard responses.  Not the same thing I know, but I;ve had a car insurer try and refuse to pay based on what was allegedly in my policy.  I did the above and the backed down.  The agent had read out a different policy wording than the one I had.  Was worth about £2k as it was a write off.

Citizens advice can be very helpfull with this sort of stuff,my brother had a problem with an ex job/insurance claim  thingy that they sort of helped him sort.

Cheers guys for all advice.  Just to let you know that I have written a formal complaint to the insurance company which was ignored apart from they'd offer to pay for the excess if my horse died.  I forwarded the complaint to the financial ombudsman who can help but will take over 6 months.  

I filed the claim with the small claims court a month a go and they had til Friday to respond.  to which they did.  They now have 28 days to make a defence against me.  

I will contact the citizens advice people, cheers Yeovil.

I have also forwarded my complaint to Watchdog and I've emailed the RSPCA.

Just wait. Legal Proceddings are abit like a game of chicken sometimes and it can be a case of who blinks first.

Both sides are aware of the issuies and you only have a certain amount of time to respond. As with most games there are ways to give you more space etc and different tactics. I find that being as diffcult and as quite as possible is the best trick. Just do the minial required by the court other wise you can play into the TPs hands by giving your hand away to soon. Also if you start shiting it when the other side put in a defence it can show you as being weak.

E&L Insurance limited.

They advertise themselves as Entertainment and Leisure Insurance and Equine & Livestock Insurance.

They insure people's weddings and things like that as well as pets.  God help anyone that has to make a claim for anything.

They have also upped my premium without telling me since all this has been going on.

Nobody touch them with a barge pole.
