He talked about how the original deal was very clear and detailed but how nothing was changed in it for months and the contract being based on that. He also talked about the complex structure of the club complicating things saying "the club is a mess". He talked about 'missing deadlines becoming a habit' and how he kept trying to push for clear agreements at meetings. He just couldn't see any progress being made. He thinks there are two scenarios: One is struggling on for a few months. Two is the creditors and IR closing the club. He talks about paying off part of the debt to the Revenue but is sure that they or the creditors will move in soon. He thinks the IR are annoyed after Leeds and will be likely to do it. He says 'they must have run out patience by now'. ASked if he can see the club being around in six months time - "he say yes but probably in a different form". He does admit that there will probably be buyers around after liquidation but it won't be him as he liked the footballing prospects and the chance of Championship fooball. He talked about being in the Championship in two years. The quote that sticks in my head is when he was asked about resurrecting the deal: "I think time has run out for this club. I honest think time has run out". As for Swindon fans he said: "I'm sorry. It shouldn't be happening to you. It is as simple as that". He also reiterated the end of the statement thanking everyone involved at STFC - apart from the board. We stop trading and appoint a liquidator who I would presume would keep the club ticking along while a notice hits the London Gazette. I think this could allow for a ‘phoenix’ as Fitton mentioned in his BBC interview the liquidator could then attempt to sell the club's assets to a connected party and the club transfers to a new company. No idea if the League would sanction this but I think it’s similar to Leeds transferring their share to a new company. We would be hit with 15 points and away we go. What’s interesting though is the development rights that have been transferred to another company could not be included in any liquidation sale. Lord knows how enforceable they are though under a new company name. Unless of course St Modwen or Shaw Park Developments are attempting to buy the company back and write off the debts. From what I can tell there are measures to stop directors buying back the club as a means to wipe the slate clean and a full investigation takes place as to why the club has hit the shit. I believe any liquidator would also look at why better offers to buy the club have failed and there's the risk of people ending up in the shit if it's found they have been trading while insolvent or pulling strings. But it is possible it’s called a phoenix and it’s worth a Google. The assets would be advertised for sale in the London gazette and sold of to the highest bidder. If successful those assets would be transferred to a new company, none of the old directors could serve on the board and away you go. Under normal circumstances in liquidation Bloggs plumbing could transfer over to Acme Plumbing inc and continue trading under the new name having wiped all of it’s debts off. The problem is the FA would have to allow the transfer of the share to the new company and although Leeds pulled that off they were not already under a CVA. I think the reason the League granted them “exceptional circumstances” was because they agreed to pay all footballing creditors in full and set up a CVA to repay remaining creditors 11p in the pound. The main problem is they pulled that off post season they had time to negotiate getting their golden share back. Mid-season could be another matter and HMRC are looking for a test case at the moment to challenge the FA and clubs working the system like this. I’ve no idea on the development rights situation and I think it would all tie in with how it’s structured if at all. Pissing into the abyss with this but if it’s tied into the club’s name then transferring everything into a new company may be a way of making the hole development rights situation null and void.
