I bought an Xbox 360 from PC World in august, i had it for 6 days and it got the red ring of death so i took it  back and exchanged it, now this xbox 360 has gone faulty after 6 weeks.

I went into the store the other day and asked for a refund and was told i couldn't have one, they had no xbox 360's in stock so i said i want a refund please , again they said no.

I spoke to PC World customer services last night and they said i could have a refund so i went in again today and i was in there for 2 hours, again they had no stock i asked for a refund and was told no, i told them i would seek legal advice if i did not get a refund but that did not work.

I am not exchanging it as far as i am concerned i'm not buying anything from that shit shop again.

Where do i stand legally on this matter? does the sales of goods act cover me in any way?

Really i could do with a phone number and an address for head office, maybe if i threaten legal action they may force the store manager's hand?

I thought maybe someone on here would know a thing or two about these kind of things.

I'm pretty sure that microsoft will send you a new one. Didn't they do some sort of crazy extended warrenty thing because they kept going mental?

Just quote them the Sale of Goods Act. Tell them it wasn't fit for purpose and you want your money back. They can't downright refuse a refund:

Thanks for that, i did mention the sales of goods act but they were not interested, they had some xbox 360 elite's in store and i said as a compromise if they knocked £20 off the elite to £280 that would match the price i paid for my xbox 360 premium and i would exchange it even this was refused so i'm only going for a refund on the matter now.

To be honest i think head office will try fobbing me off with the same rubbish, i need to force their hand but i don't really know how, i've mentioned the sales of goods act and informed them i would take legal action if i did not get a refund but they was not having any of it.

Semnd it back to microsoft, thats what i did. They paid for P&P, I got a new 360 and a 3 year extended warranty.

Yes they did, they extended everybody's warranty to 3 years.

arriba's advice is the best way to go though, shops normally get a bit twitchy if you mention trading standards.

Goods have to be fit for purpose and if they're not then it's your prerogative to decide on refund or replacement. The responsibility lies with the retailer not the manufacturer, so if they're being as unhelpful as you say then take the names of the shop staff who refused (and let them know that's what you're doing) and write to head office explaining the situation. Ask for a replacement / refund plus compensation for costs incurred (i.e. travel) when you initially took the item back and mention that you will report them to Trading Standards under the sale of goods act if it's not resolved to your satisfaction. That usually does the trick

dont forget your receipt!

if you paid by credit card you may be able to get them on the consumer credit act too, as it's over £50. you would have to speak to your card company about that one though.

I had the ring of death when my Xbox was 11 months old. Took it back to Tesco and paid the extra £40 to get the Elite version as it does not suffer from the same fate due to a motherboard re-design. Don't mind paying the extra to get the Elite as it has a bigger HD and is cool black. Even better Tesco didn't check the Xbox i returned properly as I 'accidently on purpose' forgot to pack away the controller in the box. Now I have two controllers, one white, one black!

3 red lights i got mate, it wouldnt play the games or it would load them up, make a funny sound and then lock completely, fucking did my nut in.

I went into currys today and exchanged it and the premium i got was manufactured at the end of august and has the new falcon chip, heatsinks and fans in it so i don't think the red ring of death will be a problem anymore, these new chips should solve that problem.

I was lucky that they had only just come in and i didnt get old stock from earlier in the year.

If anyone is going to be getting an xbox 360 premium console soon, look on the box and check to see if it is lot 0734 or higher, also look for the words TEAM FDOU on the side of the box as these are the new Xbox 360 premiums with the new 65nm falcon cpu chips in with new heatsinks/fans plus a HDMI port.

It is almost silent compared to the older premiums which are noisy, i haven't tried out the HDMI yet but it seems so much better.

My XBox is quite loud and has team ADUE on it. Does that mean it'll be fooked in a few weeks?

The premiums are prone to get the red ring of death unless you are lucky, i know load's of people who have had the same problem.

The new premiums are exactly the same except they have a new smaller cpu that makes it cooler and it has a new heatsink and HDMI port, they are supposed to be alot more reliable.

Have i got to do that before the money clears into my account? as i have previously verified my account for buying stuff.

How safe is that though? as i cant muck the guy about and need to post the 360 off sharpish.

I'm pretty sure to be a seller your account has to be varified to recieve incoming money. When the five days is up, either get a statement from your bank or ring them etc. and I think you just have to input these two small amounts (paypal put into your account), on the paypal screen somewhere and your account will be varified. I did it a over a year ago so things may be slightly different now :?

Ive just checked my balance and the money has gone through, im off out shortly to get my ps3.  :)
