Title: Winding up petition
Post by: Fred Elliot on Thursday, October 4, 2007, 20:08:56
OK following on from Alans post.

In 15 years in business, I have issued 4 Winding Up Petitions against our debtors, and have liquidated only one.

The other 3 scenarios was a jolt to focus their minds and grasp the nettle so to speak, we worked with the companies involved and , over a 3 year period realised 70% of our debt.

To have a company issued with this would not only focus the minds in the boardroom but would also galvanise the silent, apathetic fan base that we seem to have

Is this a viable option ?

I don't see why the FL would get heavy Fred.

Customs and Excise (as it was then) issued a Winding Up Petition the season before last for non-payment of VAT. No fall out - it was paid before it got to court.

I completely agree with your post though.

In fact I would prefer that it was a "friendly" party who issued it, then there might be some leverage. Particularly if it was for some fuck off amount that the club couldn't hope to find.

Could not agree more mate

It forces the hand, focuses the mind and issues a timeline.

Exactly what this fucking shambles needs

Can we, as a stakeholders in the club, issue a winding up order ourselves?

No mate, legally in order to issue a W.U.P you need to be a creditor (without interest) of £750.00 or more

I think there is a lot to be said about heavy leverage, but this could kill the club entirely.

I voted yes because I'm sick of the prospect of another season of political shit taking everyone's energy away from the footy.   We are going to have to face the financial music and I'd rather it be sooner than later.  If a WUP gets Diamandis and co out of the boardroom instead of hanging in there playing stupid fucking games them so be it.  We know there are viable alternatives waiting in the wings - it's time for them to be given the opportunity.

Its only a good idea, if it results in the desired result.

Unless you can guarentee it will give us the result we want, then no its not a good idea.

I'd rather have a shit club run by a bunch of no nothing wankers than not have a club, sadly

If thats the choice that needs to be made, the board win it.

The FL just want to know that we are going to run an orderly ship.

If, by bringing the situation to a head and giving it a timescale, a WUP is a vehicle to achieve that then I think it is viable

Hey hey.

I was pointing out that we may get one whether we want it or not.

By third party creditors. Who don't give a shit. They will go the whole hog just to get their money back from liquidation as the instigator.

Wouldn't it be better to pre-empt that - as Fred is suggesting?

So there's no way of staging some sort of 'citizens arrest' as it were?  If you catch my drift...

Yeovil started it. It was just my bit towards the "80% bollocks" and my miserable attempt at humour.

Sorry I can't find the link from ages ago,  I'm on a really slow wifi connection - but I remember Fred posted an explaination of the wind up process from when the petition was issued until the eventual day court when the game would be up for the club.  As I remember there was a crucial gap where a willing and able buyer could nip in and prevent the club going under.

I voted No..
A WUP puts us perilously close to the final nail IMO...

I voted no as well.  The problem here lies with the old administration, not the potential new one.  We have been saying for years that Diamandis had been hiding the skeletons away in the closet, and now we're paying the price.

Unfortunately, any potential bidder for the club - and that includes Bill Power - would run up against the same problem that the Little/Veiga people are: they don't know what they're buying, because Diamandis has created a financial fuck up of epic proportions.
