Has anyone ever successfully appealed a parking ticket on the grounds that road markings in the restricted area are not continuous and do not have the required T Bar endings, therefore varying from the prescribed regulation - i.e they can't enforce parking regulations as they aren't fit for purpose?

I wanted to learn about this, there was a program on ITV, i think, a few months ago which talked all about doing this.

It was ace, and implied not so much that you can appeal, but that they have no right to ticket you in the first place as they're not complying with the law when marking the restricted zones.

There's a book about it somewhere.

Just pay it, much easier than gettinga  double fine.  Unless I am in a meeting I never pay, 5 years I think ive had one or two and thats fair for parking.

- mind you most of the time I dont have ground to appeal as its because I have forgotten to purchase a car parking ticket as I was either chatting/in my own little world  :oops:

I've a friend at work with the same situation.

The first fine he had he objected to as the double yellow lines were exactly as you described.  He had this ticket cancelled.

Since then he has had fines for parking on the actual pavement.

The lines on the road have still not been repainted and his latest fine is again for parking on the double yellow.  Again he has contested this stating that the lines are non existant and no t-bar.  This one has actually gone to court as he has multiple fines and is no longer willing to pay them.

You may be able to contest this one if it's your first fine for that area.

It is my first. If the Council reject it, i can still pay the discounted fine anyway as long as i've appealed within 14 days as teh clock stops, but i'm pretty sure with photos, a legal case to cite, and some clever wording, they'll drop it.

Everytime I've had a ticket its always my own fault anyway!

brighton and hove have the highest number of tickets given out in great britain. even higher than london!

i have had approx. 20-30 tickets, i have contested every one and have only paid 2.

I won an appeal the other month when some Nazi gave me a ticket for not having a tax disc.  I’d literally pulled up, spotted the cunt watching me and made a bit of a drama of peeling the disc off to get a change of ownership on the car.  The fucker issued a ticket within seconds of me going in the Post Office.

Fortunately the Post Office gave me a receipt with the time on it and it was annulled but no apology at all rather a patronising photocopied letter advising on this occasion Mr X had decided to withdraw the ticket.

Yes I have, and yes you can appeal and will win if you took photographs on the day that the markings in the restricted area with your car parked were not continuous.

After reading this thread, something tells me I should have appealed my previous parking tickets................

I've had some right fucking battles with the authorities down the years, especially with regards to residents parking....I get this peculiar red mist descends on me just thinking about it.

  A particular favourite was when part of the street was coned off and the wardens stated, this suspended residents parking, I got onto the Civic Offices and they told me I didn't have to move the car, as it was there before the coning came into effect.

    I moved the car one space forward, so that I could more easily clean it,  it was still in the coned off part....the wardens came back and issued a ticket....ha says I I've been onto the Civic blah blah.....they say how do we know you didn't drive out and come back....

    After a lengthy series of appeals, I eneded up having to pay the fine....

    Bureaucracy is avery time consuming and often expensive thing to take on.

You've got to wonder why anyone would actually want to be a traffic warden. Essential qualities - was bullied at school, low self esteem, distantly related to Hitler.
