Post by: Sippo on Wednesday, July 4, 2007, 08:43:40
Are they any good? Has anyone used them before? Need a second opinion on my housing situation but don't want to waste my time if its just a bunch of monkeys at the other end...

Not used them, but they do employ properly qualified legal professionals so they should be able to give you some proper advice.

i thought once you sign, you are then liable to a percentage of compo is the seller-buyer pulls out?
i reckon you could due some dosh.your solicitor dealing with the purchase should be able to advise i would think

Title: Citizens Advice Bureau
Post by: genf_stfc on Wednesday, July 4, 2007, 13:18:43
i was about to post that too -  i think under the law once contracts  are signed then if either party pull out they are liable for 10% of the selling price in compensation.  Which actually could work out as a nice little pay out for you (unless you aren't a first time buyer and owe someone below you 10% if you now have to pull out too..)

Title: Citizens Advice Bureau
Post by: Sippo on Wednesday, July 4, 2007, 13:18:46
He says I can sue but then theres no guarantee I'd get anything. We just have to sit and wait which is the worst thing about it all.

Which is why I'm completing on my sale on friday to stop being sued myself. So i'll be chain free.

If sippo wins, he will have costs covered.  Its a pretty open and shut case.  You will have up to 6 years to hit him for the money, id go for an attachment of earnings its a nasty thing

Got a second opinion through the CAB. He's in negative equity which is way this has all happened. its all  a bit shit. I can't sue him for what he hasn't got.

Well my solicitor says you can sue. But what chances are there of him having any money? Specially if he can't afford the mortgage/loans. The mortgage company would sue him for more, then all I'd get is a piece of paper from the courts which won't even be worth the paper its written on. All I get is a huge bill.  :x

WTF?!?!

That's not possible, surely?

The mortgage company(ies) would want to have a charge over the property and they'd never accept a mortgage if somebody else already holds a charge.

Happens a lot

See if you can get your brief to put some pressure on the sellers lender, it's their call really if he can sell whilst in negative equity. You could argue it'd be better for them to at least recoup most of their debt and then pursue the outstanding amount afterwards.

You can have 2 mortgages on one property.  I have 2 from HSBC on my home, one when I bought it

One to cover teh 10k overspend omn teh refurbishment

Onto de vere:-

They said one room cost 70, one of teh guests in that room got another room on my card at another 70.  Then the other 70 was from moving guests due to noise.  Also 47 on my room at bar by more than one person they said.

If any of the guests feels like chucking me money id appreciate itr.  If not I just will keep thinking your all cunts.  Simple
