Anyone claimed theirs back yet??? Im in the middle of my 40 day Data protection wait for 6 years worth of bank statements. Looking forward to claiming shit loads back from Abbey (£400 in the last year alone!!!)

I just sent my letter in claiming £500 odd over the past few years, I've got all my statements though.

That'll teach them for refusing me an overdraft

Thanks sonic. Do you know what the deal for credit cards is, as that article is a little shallow in telling you what might be unfair charges.

 And does it still apply for accounts that are no longer open?

it's the actual size of the charge that's being touted as 'unfair'.

bang in a claim for any credit card charges. i think closed accounts are fair game too. none of the banks or building societies have stood up for themselves in court yet but i think one of them will do soon.

I'm assuming 'Interest Charges' are not included then? I've certainly got some late fees on credit cards that I assume are covered, so I'll give that a try. Thanks all.

(Sorry for asking so many dumbass questions btw. I've missed a load of this stuff having been out of country for two years...)

i guess if the interest charge came about as a result of being charged, then you can claim them back as well.

timmy, i think it says more about the charges than the individual. in some cases you get charged, for being charged.

Dead easy. You have an account which goes overdrawn (or over the agreed overdraft limit) which has got (as most people do these days) a series of direct debits set up on it for phone bill, council tax bill, gas, leccy, etc etc, all set to go out roughly the same time each month. If you don't get the thing back inside the limit before they hit, you get charged separately for each direct debit, even if it's all the same day (and so effectively the same "instance" of being over the limit). That'll burn through 250 quid's worth of charges without touching the sides. Arguably, it's your own fault for not keeping a closer eye on things, mind, but if you only went a fiver over in the first place, it's a touch excessive as a punishment!

i'm just about to spend £150 on taking Barclays to the small claims court.

They owe me £2545. they have already offered me £100 as final settlement but i refused.

once i have the £150 i'll send it all off. then it should take 30 days from then i believe

You can either pay £25 for each one (another stupidly huge charge for such a small request) or can make a Subject Access Request under the Data Protection Act 1998 which basically entitles you to everything on your bank's records. The maximum charge they can make for this by law is £10, and that includes everything.

With a SAR they'll give you a 40 calendar day deadline which they have to stick to by law, but they'll normally respond before this.

i'me putting in my claim to the courts too. Once i've filled out the relevent excel sheet which adds the 8% APR your allowed to add.

should boost mine from £2545 to nearer £3k.
Plus i can claim back the £120 to file it at the courts too  8)

My final total was £3171.78.

I will receive details in the post letting me know when Barclays have to respond by etc and that should give me an indication of when i should get my money
