Specifically the fact that it makes anything incredibly difficult.
Without going into detail I own a house which my mother lived in until recently (with a restriction that I couldn't sell it without her approval to ensure she could live there as long as she wished).
She has developed dementia and has sadly gone into residential care for the duration, however family have decided that she no longer has the mental capacity to sign the paperwork to allow me to sell the house.
So I am stuck with a house that I don't need, cannot sell and no one seems to be able to identify an easy way out of the situation?
Any solicitors on here?

Really, it's not up to the family to decide whether she has mental capacity. The courts will decide that (or rather, a 'certificate provider'). If she does not have capacity then you (or another family member) need to apply to the Court of Protection to act as her Deputy.
