Afternoon gents,

Hope someone is able to shed some light.

Last year the mrs bought a new Toshiba laptop from Argos, since then it has been nothing but a problem and recently has decided to not even turn on.

Within this time it's been sent off for repair twice for different faults each time.

As it's still within it's 12 month warranty is she entailed to a refund of any kind either from manufacturer or retailer rather than them trying to send it off for repair again?!

If so, does anyone know how she'd start this process, an email to Toshiba customer service would be my educated guess.

Any help is appreciated, cheers!

Purchased from Argos, guess you would return it to Argos.  They then have the option of repair or refund, guess they will repair.  I would also email to Toshiba and ask them what they are rpepared to do about it - you obviously got a Friday afternoon model!!

The Sale of Goods Act 1979 gives you certain statutory rights when you buy something that the retailer, in this case Argos, are responsible for fulfilling. This includes what they must do if you receive faulty goods and is separate from any warranty you may have.

The key for you is that any goods must be fit for purpose and last a satisfactory amount of time. It sounds like the laptop doesn't meet these criteria.

I'd write to Argos Customer Service first, explaining that the laptop isn't fit for purpose despite being in for repair a number of times and requesting either a full refund or a replacement as the repairs have obviously been unsuccessful.

If you paid for it with a credit card, then you've potentially got a case against the card issuer as well.

Today she got a full refund from Argos.
